Stewart was born in Westchester County, New York, the son of Lispenard and Mary Rogers (Rhinelander) Stewart. After graduating from Yale in 1876 he studied law at Columbia and began his practice in New York. Stewart served briefly in the New York Senate (1889-90), and from 1895-1903 he was president of the State Prison Commission. His portrait was a gift to the Society from his niece.
